DAVID ROWE STATED THAT IT WAS BUJU BANTON WHO APPROACHED THE INFORMANT ABOUT COCAINE

In his opening statements in the cocaine trial of Mark ‘Buju Banton’ Myrie, his attorney David Oscar Markus, said the only thing his client was guilty of was “talking too much”. As the case unfolded, the world heard how much “talk” it was as tapes were played of the reggae superstar loosely serving up his most confidential secrets to a man he had met on a flight from Madrid to Miami.

Tapes were played of Buju telling the informant that he smuggles diamonds from Africa to Europe and that while he funds cocaine deals, he doesn’t actually get involved.

Speculation has been rife that the informant, Richard Alexander, who Buju Banton met on that ill-fated flight, had been strategically placed next to the reggae artiste on the plane for the specific purpose of entrapping him.

However, attorney-at-law, David Rowe, who has been overseeing the case on behalf of several media houses in Jamaica, says there is no evidence to support that school of thought.

According to Rowe, the transcripts show that it was Buju who actually approached the informant about cocaine and not the other way around.

“The initial contact was made on a flight from Madrid to Miami … it was Buju who approached the informant. They are on the plane drinking red wine and Buju asks, ‘Do you know who I am? I am Buju Banton, the big reggae superstar.’ And after that the conversation went from his stardom to his ability to engage in the sale of cocaine. That’s what the tapes said.” Prof. Rowe told Sharon Gordon and Bro Carlyle last Thursday night on their programme. “Buju left his number on a napkin for the guy to keep in contact with him,” Prof Rowe added.

He added, “The informant is a Colombian … he does Colombians, he doesn’t normally do Jamaicans.”

However, since his job is that of informing on cocaine deals, when Buju told the informant his story, Johnson did his job, Professor Rowe pointed out.

When Rowe made this revelation on the programme, the listeners in the chat-room went berserk. They protested Buju’s innocence. He again infuriated the chat-room when he added, “The law in the US is extremely blind, it doesn’t really care that Buju Banton is a reggae superstar from Jamaica”.

Rowe defended himself by pointing out that in addition to the fact that doesn’t know Buju Banton and had nothing to gain, the transcripts have been made public and anybody can check them.

“Buju,” he emphasized, “ made some very damning statements out of his own mouth on the tape. And he has a song, Driver, in which he says it all.”

Reggae's living legend and survivor of The Wailers Fame consisting of Robert Nesta Marley O.M., Winston Hubert McIntosh, Neville O'Riley Livingston C.D. pka Bunny Wailer has on behalf of Tuff Gong Records Ltd and The Wailers, been involved in the process of reclaiming the copyrights and sound recordings in over 1300 Wailers Songs from 1962 to the present, intentionally to compile and represent a series of Luxury Collector’s Edition of Boxed Sets titled ‘The Wailers Legacy Series’.

Volume 1 of the Series which incorporates 117 Songs of The Wailers along with Musically Speaking Volume 1, 2 & 3 a professional history of The Wailers written and narrated by Bunny Wailer is currently in the market, compiled during and over the period from 1995 to its release in 2005.

This coincides with the 35 Years expiration period of copyrights that allows for artists since 2003 to reclaim ownership of their songs ahead of the 50 Year expiration of associated rights in sound recordings, when they go into Public Domain.

It also stands to clarify the failure of the Marley Estate in their attempt to reclaim and revert the rights of Bob Marley & The Adopted Wailers in the recent lawsuit filed in the New York Southern District Court against UMG which ruling is questionable by Bunny Wailer, the survivor of The Wailers as it concerns Work For Hire.

HAPPY BIRTHDAY JUNIOR DEMUS 10/6/10

Conrad McNish a/k/a Junior Demus was born in St. Mary, Jamaica, West Indies. Junior Demus is known for his gruff, gravel-voiced chants and jokes that he can give at the drop of a hat. He is also known to draw an audience in.

Junior is a legend in his place of birth Jamaica, a fixture in Brooklyn, New York and its dancehall scene. He is also a very warm and friendly individual. One of his favorite quotes/jokes whenever he meets up with people "stress can kill you, you can't hold it in or it will give you cancer, let it out" then laughs and walk away.

"When Me Come" released in 1991 was Demus' first single. 1994, Luke Records released Demus' debut full-length album, Bad Fowl. Some of the tracks from this album are "Come Quick," "Son of a Gun," and "Hold Me Down." He has also recorded a number of other singles, including "One Master," "Good Over Evil," and the popular number "Cabin Stabbin," which he completed with Super Cat and the late Nicodemus. They also worked together on the album The Good, the Bad, the Ugly, and the Crazy for Sony Music in 1994.

Some of his other known songs are:

"Ruff neck chicken"
"Shot mek u riddle" (this was in the Dancehall Queen movie)
"Johnny Bop"

Demus has lent his talents on several dancehall and reggae compilation albums filled with hard hip-hop tunes by artists like the Frisco Kid, Wicka Man, Foxy Brown, Rob Symeonn, Sugar Minott, Sluggy Ranks, and many other artists.

The agreement that has been referred to and relied on by the U.S. District Court, Southern District of New York, No. 08-06143 that denied the return of copyrights to the Marley Family, and inferred that Robert Marley’s solo contract and The Wailers group contract with Island Records was ‘Work For Hire’ is in direct contravention with the facts and history of The Wailers. This information can be supported by the legion of published books and recorded interviews that have been done to date.

The Wailers, Robert Marley O.M., Winston McIntosh and Neville Livingston C.D. have since 1964 entered into a series of formal recording contracts as Recording Artists and Writers since that time and subsequently as solo Recording Artists since 1974, starting with
• Jamaica Recording & Publishing Company/Studio One,
• Wail ‘N’ Soul ‘M’ – the first independently owned label for The Wailers,
• Upsetters/Lee Perry a Joint Venture and
• Danny Simms/JAD where in this instance only Robert Marley & Peter Tosh signed on,
• Chris Blackwell/Island Records where the world knows the story of the group being given $4000 on ‘faith’ to go and record the Catch A Fire album.

• Tuff Gong Records Ltd & Tuff Gong Music - Solomonic/Tuff Gong Records Ltd where the group themselves owned and transferred their own recording and publishing interests

This judgment is coming forward in the general environment of 50 Years of Jamaica’s music industry where expiring copyrights are threatening some of the world’s major catalogs from such greats as Elvis Presley, The Beatles and certainly now The Wailers to revert to either the bands themselves and or Public Domain. This represents one of the greatest threats to the major record and publishing companies, their catalogs and dominance over the genre Reggae.

It is in this environment that this sudden revelation that Robert Marley in his solo career, contract and subsequent Estate with Island Records/Universal is suddenly being deemed a ‘Work For Hire Artist’, a clearly underhanded conspiracy, years in the making, to defraud not only Robert Marley but The Wailers collectively of their rights to the reversion of these copyrights and opens up a Pandora’s box of violations and breaches by Chris Blackwell/Island/Universal and their agents in this matter. This as the only caveat to the reversion of these rights is if the recorded work was done ‘Work For Hire’.

It is further interesting to note that in the 1992 lawsuit by Tuff Gong Records Ltd., challenging Tuff Gong International rights to trade outside of Tuff Gong Records Ltd. as owners of The Wailers Recordings and trading unchallenged in Jamaica and The Caribbean since 1973, without the negotiated interest of Neville Livingston C.D. and the Winston McIntosh Estate as co-owners, that a series of contractual agreements, reported in the various journalistic reports, during this period was done converting and transferring rights that involves The Wailers, bringing into breach attempts at settlement, that never in those negotiations indicated that The Wailers recordings and interests were transferred and converted to ‘Work For Hire’ during this time.

Solomonic/Tuff Gong Records Ltd. can clearly state that at no time in the history of The Wailers as a group or as solo artists with Island/Universal has ‘Work For Hire’ been associated with any business dealings. We have contacted our lawyers in Jamaica, USA and the UK to vigorously move forward with existing plans and negotiations to recover the copyrights of The Wailers, sue for various breaches of existing settlement agreements and for intentional interference with prospective economic advantage and to invoke the Berne Convention in the protection of all related rights in international territories outside of Jamaica.

Is Robert Nesta Marley and Bob Marley separate and apart or one and the same or does Robert Nesta Marley or his respected Estate own the trade name Bob Marley, if not who does?
